Terms of Service

The agreement between you and Swaptico governing your use of the marketplace, including eligibility, listings, swaps, paid features, moderation, liability and disputes.

1. Introduction

These Terms of Service ("Terms") are a legally binding agreement between you and Swaptico, the operator of the Swaptico marketplace, when you create an account or use the platform. By registering, you confirm that you have read, understood and agreed to these Terms, together with the documents they link to: the Privacy Policy, Marketplace Rules, Prohibited Items Policy, Fraud & Abuse Policy and Intellectual Property notice. If you do not agree, please do not use Swaptico.

2. What Swaptico is — and what it is not

Swaptico is an online marketplace that helps people find each other and coordinate exchanges ("swaps") of items they own for items they want, with an optional cash adjustment agreed between the participants. Swaptico provides the matching, messaging, listing, moderation and record-keeping services that make swaps possible. Swaptico is not a party to the swap itself: it does not buy, sell, hold or take title to any item, does not transfer legal ownership, does not act as an agent, broker or escrow, and is not a carrier or delivery service. Ownership of each item passes directly between the users involved, subject to applicable law and — for complex assets such as vehicles or property — a professional external process. Swaptico does not provide legal, conveyancing, valuation, insurance, tax or financial advice. Paid features such as Pro and listing boosts are services Swaptico provides, not transactions in goods.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use Swaptico. By creating an account you confirm that you meet these requirements. You may create and control only one account at a time; you may not create accounts on behalf of other people without their permission, and you may not create new accounts to evade a suspension, ban or restriction.

4. Your account

You are responsible for the accuracy of the information on your account and for keeping your login credentials secure. You must provide truthful registration details and keep them up to date. You must not share your password or let anyone else use your account. If you believe your account has been compromised, change your password immediately and contact us. You are responsible for all activity that happens on your account. If you are a business or trader using Swaptico, you must identify yourself as such and comply with the additional obligations described in section 15.

5. Ownership and lawful possession

You must own, or lawfully possess with the right to swap, every item you list. By listing an item you confirm that: you have the legal right to swap it; it is not stolen; it is not subject to a finance agreement, lien, security interest or other restriction that prevents you from swapping it (unless you have disclosed that restriction and received the required consent); and swapping it would not breach any law or agreement. If you later learn an item you listed was not yours to swap, you must remove the listing and tell the other participant and Swaptico immediately.

6. Listings and wants

Listings and wants must be truthful and accurate: describe the item's condition honestly, use photos that genuinely show the item you are offering, state any defects or damage, and set out any conditions of the swap clearly. Do not list anything prohibited by the Prohibited Items Policy, and follow the Marketplace Rules for restricted and high-value categories. Wants must reflect things you genuinely seek. You are responsible for the content of your listings and wants and for keeping them accurate while live.

7. Transactions

A swap begins when one user makes an offer (proposes an exchange involving their item or items and the other user's item or items, with an optional cash adjustment) and the other user accepts it. Unless a specialised workflow applies (section 11), the swap completes when both sides meet the agreed conditions — for example handing over the items, or despatching and confirming delivery. Swaptico's records (including the swap timeline, messages and confirmations) are the evidence of what was agreed. Cash adjustments are capped at the limits shown in the app for each transaction type. Swaptico does not hold or release funds for cash adjustments unless a payment feature is explicitly provided for that transaction in the app. You are responsible for completing the swap you agreed to, in good faith and on the agreed terms.

8. Fees and paid features

Creating an account, listing items and swapping is free. Swaptico offers optional paid features: Pro (a monthly subscription via a third-party payment provider, which adds benefits such as priority placement, seller analytics and extra credit boosts) and listing boosts (paid or earned credits that increase an item's visibility for a limited time). Subscription charges are processed by our payment provider; card details are never stored by Swaptico. Subscriptions renew automatically until cancelled, and you can cancel at any time — benefits continue until the end of the paid period. Boosts never bypass moderation or safety checks. Reward points and levels are a status system and can never be converted into cash. Prices, plans and benefits may change; we will tell you about material changes before they affect you.

9. Reviews and user content

Reviews and ratings must be honest and based on your own genuine experience of a completed or attempted swap. You keep ownership of the content you post — listings, photos, descriptions, wants, reviews, messages and reports. By posting content, you grant Swaptico a limited, worldwide, non-exclusive, royalty-free licence to host, display, reproduce and process that content to operate and improve the marketplace, including for search, matching, moderation, fraud detection and record-keeping. This licence ends when you delete the content or your account, subject to legal retention obligations. You confirm that your content does not infringe anyone's rights and that you have the right to grant this licence.

10. Acceptable use

You must not use Swaptico for any unlawful purpose or in any way that breaches the Marketplace Rules, the Prohibited Items Policy or the Fraud & Abuse Policy. This includes, without limitation: listing prohibited items; posting misleading or fraudulent content; harassment, threats or abuse; attempting to take transactions off the platform to avoid its protections; creating duplicate accounts; manipulating reviews, rewards or referrals; and attempting to evade a suspension, ban or other moderation action. A breach may result in content removal, transaction cancellation, account suspension or termination, preservation of evidence, reporting to relevant authorities where legally required or appropriate, and legal action where applicable.

11. Complex and high-value assets

Vehicles, property, luxury goods, art and other high-value or regulated categories follow specialised workflows. These workflows may require identity verification, proof of ownership, vehicle history and finance/lien checks, professional review and a contract stage before a transaction can complete — see the Prohibited Items Policy and Marketplace Rules for the requirements for each category. Swaptico's specialised workflow coordinates and documents the process; it does not itself transfer legal ownership, and it does not provide legal or conveyancing services. For property and vehicles you are responsible for completing any legal transfer through the appropriate professional and legal process in your jurisdiction. Cash-adjustment limits for these transaction types are shown in the app.

12. Moderation and automated systems

Swaptico operates automated screening systems that analyse listings, messages and activity to detect prohibited, fraudulent or abusive behaviour (see the Privacy Policy and Fraud & Abuse Policy for details). These systems flag content for review and, in limited, reversible cases, take bounded action such as hiding a listing pending review. They never automatically ban users or delete accounts. Every material decision is reviewed by a human moderator before enforcement, and every decision can be appealed (section 13). Risk scores are advisory and a single weak signal never results in a ban on its own.

13. Suspension, termination and appeals

We may suspend or terminate your account, remove content, or cancel a transaction where we reasonably believe the Marketplace Rules, these Terms or the law have been breached, or where required to protect other users, the platform or the law. We will tell you the reason wherever reasonably possible. If you believe a decision was wrong, you may appeal: reply to the notice you received, contact us at legal@swaptico.com, or use the appeal option in the app. Appeals are reviewed by a person, and confirmed violations are recorded against your account. You may close your account at any time from Privacy & Data settings; see the Privacy Policy for what happens to your data.

14. Disputes between users

Swaptico is not a court, insurer or dispute-resolution service. If a swap goes wrong — non-delivery, incorrect or damaged items, or a suspected fraudulent swap — you should first contact the other participant through the app's messaging. If that does not resolve the matter, raise a dispute through the app: both sides must provide evidence (photos, tracking information, correspondence, confirmation of delivery). Swaptico moderators may review the evidence and, where appropriate, take action under these Terms, cancel the transaction, or report the matter to relevant authorities (including the police in the case of suspected crime). Swaptico may preserve evidence and records during an investigation, including after an account deletion request where legally permitted. Your statutory rights as a consumer are not affected.

15. Traders and consumer rights

If you use Swaptico as a private individual, you do so as a consumer and you retain all rights you have under the consumer-protection laws of your country of residence that cannot be excluded by agreement. If you use Swaptico as a business or trader (for example, selling goods in the course of your trade), you must register and identify yourself accordingly, and you may be required to provide additional information (such as a business address and tax identifier) so that other users and authorities can identify you, as required by law. Nothing in these Terms limits Swaptico's liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded by law.

16. Liability

Swaptico provides the marketplace platform "as is" and, to the maximum extent permitted by law, disclaims all warranties about its availability, accuracy or fitness for a particular purpose. To the maximum extent permitted by law, Swaptico's total liability arising out of or in connection with these Terms or your use of the platform (whether in contract, tort, negligence or otherwise) is limited to the fees you have paid to Swaptico in the twelve months before the event giving rise to the claim. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including the Consumer Rights Act 2015 and equivalent consumer-protection legislation.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes to the platform, the law or our operating practices. When a change is material, we will notify you (for example, in the app or by email) and ask you to accept the new version before continuing to use the platform. Your acceptance is recorded against your account with the version number and a timestamp. You can always see which version you accepted in Settings → Legal & Policies. If you do not accept the new version, you should stop using the platform and may close your account.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. If you are a consumer, you benefit from any mandatory provisions of the law of the country in which you live, and nothing in these Terms removes those rights. Subject to that, you agree that the courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms. Nothing in this section prevents Swaptico from seeking injunctive or other relief in any court of competent jurisdiction.
